A long time ago (maybe a year ago) Youtube used to offer director's accounts with no time limits (but a 100 MB file size limit.) I was one of the lucky ones to get in early.

As Lawrence Lesig said "Fair Use" is not a well defined safe harbor, its a legal position.
But of course, the copyright holder might themselves, in this case, be scared of losing a court case as it would jeopordize their other holdings. But if they go to court they will bring their A game.
