He doesn't need to wave his hand like that to be a sith. Remember Qui Gon-Jinn in episode 1 with Watto. And Obi-Wan Kenobi in episode 4 with the stormtroppers. Or even Luke Skywalker in episode 6 with Jabba the Hutt.
